These Terms govern your access to and use of this website and its text, images, artwork, videos, fictional records, promotional materials, downloads, and other content (collectively, the "Site").

By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Ownership and Intellectual Property

THE BAN, its fictional universe, characters, storylines, settings, terminology, institutions, decrees, documents, artwork, and other protectable creative elements are owned or controlled by Dan Ogen, except where expressly stated otherwise.

The Site and its content are protected by applicable copyright, trademark, and other intellectual-property laws. No ownership, license, or other rights are transferred to you except for the limited permissions expressly provided below.

THE BAN, its logos, and related identifiers may not be used in a manner suggesting sponsorship, endorsement, authorization, or official affiliation without prior written permission.

2. Fictional Work Disclaimer

THE BAN is a work of fiction.

Its characters, organizations, governments, corporations, institutions, technologies, programs, events, policies, decrees, resolutions, quotations, records, reports, and documents are fictional or used fictitiously for creative purposes.

Any resemblance to actual persons, living or deceased, or to actual organizations, institutions, policies, events, legislation, or governmental actions is coincidental or part of a fictionalized creative work.

Nothing on the Site should be interpreted as a factual statement about any real person, government, organization, corporation, or international institution.

3. Resolution 2050/0001

Resolution 2050/0001 is entirely fictional.

It is not an actual law, treaty, regulation, public policy, United Nations resolution, governmental action, or real proposal.

It must not be reproduced, edited, distributed, or presented in a manner that could reasonably cause others to believe it is authentic law, official documentation, actual United Nations action, or current public policy.

Any permitted reproduction must clearly identify the material as fictional and as originating from THE BAN by Dan Ogen.

4. No Affiliation or Endorsement

Neither Dan Ogen, THE BAN, nor this Site is affiliated with, sponsored by, approved by, endorsed by, or officially connected with the United Nations, any United Nations agency, government, public authority, healthcare institution, corporation, retailer, or other real-world organization unless expressly stated otherwise.

References to real organizations, locations, institutions, or public issues are included solely for fictional, contextual, editorial, or descriptive purposes.

No fictional seal, emblem, insignia, or visual identity should be understood as authentic or officially authorized.

5. Permitted and Prohibited Use

You may access and view the Site for personal, non-commercial, informational, journalistic, or review purposes.

Unless permitted by law or authorized in writing by Dan Ogen, you may not:

copy, republish, distribute, sell, license, or commercially exploit Site content;

create adaptations, translations, sequels, spin-offs, merchandise, games, audiovisual productions, or other derivative works based on THE BAN;

remove copyright notices, credits, watermarks, or fictional-work notices;

use Site content or THE BAN materials to train, test, develop, or supply datasets for artificial-intelligence or machine-learning systems;

use bots, scrapers, crawlers, or extraction tools beyond ordinary search-engine indexing;

impersonate Dan Ogen or falsely present content as official, authentic, or authorized;

use confusingly similar domains, accounts, business names, product names, or branding;

use Site content unlawfully, deceptively, fraudulently, or in a defamatory manner; or

present fictional materials as real evidence, reporting, law, policy, or institutional action.

Nothing in these Terms restricts rights that cannot lawfully be limited, including applicable fair use, fair dealing, quotation, criticism, commentary, parody, scholarship, or news-reporting rights.

6. Press and Editorial Use

Media, reviewers, booksellers, librarians, educators, and content creators may quote reasonable excerpts from officially released press materials for legitimate reporting, criticism, review, or commentary, subject to applicable law.

Such use must:

credit THE BAN by Dan Ogen;

identify fictional material as fictional;

preserve the meaning of quoted material;

not imply endorsement or affiliation; and

not reproduce a substantial part of the work or replace the original work.

Artwork, logos, cover designs, photographs, and audiovisual material may be used only when designated for press use or separately authorized.

7. User Submissions

If the Site permits submissions, you are responsible for the content you provide and represent that you have the right to submit it.

Do not send confidential manuscripts, unsolicited plots, characters, scripts, treatments, or other creative proposals. Such materials may be deleted without review. Sending unsolicited material does not create any confidential, fiduciary, professional, or creative-development relationship.

8. Third-Party Services

The Site may link to retailers, reading platforms, social networks, payment providers, or other third-party services.

Dan Ogen does not control and is not responsible for their content, availability, security, terms, privacy practices, products, services, or transactions. A link does not imply sponsorship, approval, or endorsement.

Your use of third-party services is at your own risk and subject to their terms.

9. No Professional Advice

The Site and THE BAN are provided for literary, artistic, informational, and entertainment purposes only.

Nothing on the Site constitutes legal, medical, scientific, environmental, political, financial, psychological, governmental, or other professional advice. Fictional material must not be relied upon for real-world decisions.

10. Disclaimer of Warranties

To the fullest extent permitted by law, the Site is provided "as is" and "as available," without express, implied, or statutory warranties.

Dan Ogen does not warrant that the Site will be uninterrupted, secure, error-free, complete, accurate, or free of harmful components.

Mandatory consumer rights and warranties that cannot lawfully be excluded remain unaffected.

11. Limitation of Liability

To the fullest extent permitted by law, Dan Ogen and the Site's contributors, licensors, representatives, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for losses of profits, revenue, data, opportunity, goodwill, or reputation arising from:

use of or inability to use the Site;

reliance on fictional, promotional, or third-party content;

third-party services;

unauthorized access to Site content; or

misuse of THE BAN materials by another person.

Liability that cannot lawfully be excluded will be limited to the maximum extent permitted by law.

12. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Dan Ogen and his authorized representatives, licensors, and service providers from claims, losses, liabilities, costs, damages, and reasonable legal fees arising from:

your unlawful or unauthorized use of the Site;

your violation of these Terms;

your infringement of another person's rights;

content you submit or distribute; or

your presentation of fictional material as authentic law, policy, evidence, documentation, or institutional action.

This provision does not apply where prohibited by applicable consumer law.

13. Copyright Concerns

identification of the copyrighted work;

identification and location of the disputed material;

your name and contact information;

the basis of your claim; and

confirmation that the information is accurate and that you are authorized to act for the rights holder.

False or misleading notices may result in legal liability.

14. Enforcement

Dan Ogen may restrict access, remove content, reject permission requests, or take appropriate legal action when these Terms, applicable law, or intellectual-property rights are violated.

Failure to enforce a provision immediately does not waive the right to enforce it later.

15. International Access

You are responsible for complying with the laws applicable in your location.

If any provision is invalid or unenforceable in a jurisdiction, it will be limited to the minimum extent necessary, and the remaining provisions will remain effective.

Mandatory rights that cannot legally be waived remain unaffected.

16. Governing Law and Disputes

These Terms and disputes relating to the Site are governed by the laws of Israel, without regard to conflict-of-law principles.

The courts of Tel Aviv, Israel will have exclusive jurisdiction, except where applicable law grants a consumer the mandatory right to bring proceedings elsewhere.

Before filing a claim, the parties will make a reasonable good-faith effort to resolve the dispute through written notice sent to thebanthriller@gmail.com.

17. Changes

These Terms may be updated periodically. The revised version and updated date will be posted on this page.

Continued use of the Site after an update constitutes acceptance to the extent permitted by law.
